Hi all,

 

I was doing my daily ebay search and found this qpod that has free tax!

I spoke to the seller of this qpod, and he said he argued for ages to get the qpod made tax free and provided the DVLA with the proof they needed to make the Qpod tax free. He also said that hopefully if I provided them with the registration number of this tax free qpod they should hopefully be able to make my Qpod tax free to.. So I'm passing on the wisdom!

I will ring them tomorrow and try and get my Qpod tax free so I will report back on the results.

Hopefully this is the break we need to get tax free pods! :D

Well this latest Email from DVLA has just about knocked the nail on the head I think.  Proves one thing they don.t know what they're on about half the time.

Firstly I would like to apologise for previous correspondences which you have received which have been misleading.

I should clarify that the advice provided to you in my original response on the 19.02.12 was correct, I have copied this below for reference,

'...only vehicles with the type approval category 'M1' are taxed according to their CO2 emission figure.

The vehicle mentioned in your email is a quadricycle (category L7). Quadricycle vehicles are taxed according to their engine size.

If it is brought to the Agency's attention that a quadricycle has incorrectly been placed into a Grad VED tax class (tax class 48, 49, 59), those vehicle records identified will be amended accordingly and the registered keepers will be notified...'

As your vehicle is not an 'M1 vehicle' it will not be placed into a Grad VED tax class (tax class 48, 49, 59) regardless of what evidence you produce. Please do not trouble yourself with obtaining further evidence or sending this to us as this cannot be considered.

I must again re-iterate that your vehicle has been taxed at the correct rate in accordance with the Vehicle Excise and Registration Act (1994). DVLA are not able to exercise any discretion in this matter as the appropriate rate of duty which vehicles must pay are specified in legislation.

Where it is brought to our attention that a vehicle has been placed into the incorrect tax class our records will be amended and the registered keeper contacted.

I hope this further email clarifies our position.

 

Oh well!  Guess nobody is really surprised at this.

On the bright side, if there were no quadricycle regs, our vehicles would not be allowed on the road- no airbags, anti-lock brakes, catalytic converter, crash test standards etc.

Got to feel sorry for the poor chap who is now going to get hit for back tax!!

One futher thought though; many years ago ( early 80's) I heard of a biker who was keen not to wear a helmet.  He looked at the legislation, found that a motorised lawnmower was excluded from the helmet law; and that the definition of a lawnmower was a vehicle registered as a lawnmower.  So he re-registered his bike, and had the only road legal Triumph Bonneville lawnmower, and didnt have to wear a helmet.  Not sure where you would get insurance from, and lawnmowers are not allowed on motorways.  Anyone fancy trying??

In theory Alex, yes, however, having driven down the 70MPH rated A11 dual carriageway, it is not to be recommended!!!!!
